1.2 By accessing, browsing, booking services, purchasing gift cards, or registering for a membership on this Site, you (the "User", "Client", or "Member") agree to be bound by these Terms and Conditions, our Privacy Policy, and any other notices or disclaimers displayed on the Site.
1.3 If you do not agree to these terms, you must immediately cease using the Site and our services.
2. Jurisdiction & Australian Consumer Law (ACL)
2.1 These Terms are governed by the laws of New South Wales (NSW), Australia. You submit to the non-exclusive jurisdiction of the courts of NSW.
2.2 This Site is intended primarily for users located in NSW. If you access this Site from interstate (e.g., interstate property investors), you are responsible for compliance with local laws, noting that the service delivery itself will strictly occur within our designated NSW service areas.
2.3 Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies conferred by the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law (ACL).
3. Bookings, Pricing, and Payments
3.1 All quotes and pricing displayed on the Site are in Australian Dollars (AUD) and are subject to change without notice.
3.2 Booking Portal: A booking request submitted via our online portal does not constitute a binding agreement until confirmed by us via email or phone.
3.3 Payment Processor: Payments made through the Site are securely processed using the Wix embedded SWIFT add-on. Handyman⭐Star does not store or handle your credit card data directly.
3.4 You agree to pay all invoices promptly in accordance with the payment terms specified at the time of booking or detailed on the invoice.
4. Memberships & Accounts
4.1 To access certain promotions, features, or rewards, you may be required to create a Member Account.
4.2 You are solely responsible for maintaining the confidentiality of your account password and login details.
4.3 We reserve the right to suspend or terminate your membership at any time, without notice, if we suspect fraudulent activity or a breach of these Terms.
5. Gift Cards & Promotional Vouchers
5.1 Gift cards purchased through the Site are valid for a period of three (3) years from the date of purchase, in alignment with Australian consumer law.
5.2 Gift cards and promotional vouchers are non-refundable, cannot be redeemed for cash, and must be used towards Handyman⭐Star services.
5.3 Promotional gift cards issued via our membership tier or specific campaigns (such as the "Inflation Buster" promotion) may have shorter expiry windows and distinct terms, which will be outlined in the specific promotional terms.
5.4 Handyman⭐Star gift cards issued by can be used toward any future standard home maintenance services booked via the Site.
5.5 Compliance & Anti-Money Laundering (AML): Handyman⭐Star strictly prohibits the use of our Site, payment gateways, and Gift Card infrastructure for the purposes of money laundering or any other illicit financial activity. We reserve the right to monitor transactions, freeze accounts, refuse the issuance or redemption of any Gift Card, and report suspicious activities to relevant regulatory authorities (including AUSTRAC) without notice, if we have reasonable grounds to suspect non-compliance with the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).
6. Limitation of Liability & Indemnity
6.1 To the maximum extent permitted by law (including the ACL), Handyman⭐Star, its employees, and subcontractors will not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our Site or the performance of our physical services.
6.2 Our total liability for any breach of a non-excludable consumer guarantee is strictly limited to, at our option:
Resupplying the services; or
Paying the cost of having the services supplied again.
6.3 You agree to indemnify and hold Handyman⭐Star harmless from any claims, damages, liabilities, or expenses arising from your misuse of the Site, failure to provide safe access to properties for service delivery, or breach of these Terms.
7. Intellectual Property & User Content
7.1 All content on this Site, including text, logos, graphics, and software, is the property of Handyman⭐Star or its licensors and is protected by copyright law.
7.2 If you provide us with photos of completed work or testimonials, you grant us a royalty-free, perpetual license to use this material for marketing purposes, subject to the privacy protections outlined in our Privacy Policy.
